1. PROMOTION DESCRIPTION: The Quest Legacy Games Sweepstakes (the “Promotion”) will be held from 12:00 PM Eastern Time (“ET”) on October 19, 2023 to 11:59 PM ET on December 11, 2023 (the “Promotion Period”). Sponsor’s clock is the official timekeeping device for the Promotion.

The sponsor of the Promotion is Quest Diagnostics Incorporated (“Sponsor” or “Quest Diagnostics”). BY PARTICIPATING IN THE PROMOTION, EACH ENTRANT UNCONDITIONALLY ACCEPTS AND AGREES TO COMPLY WITH AND BE BOUND BY THESE OFFICIAL RULES AND THE DECISIONS OF SPONSOR, WHICH ARE FINAL AND BINDING.

2. ELIGIBILITY: The Promotion is open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age (or the age of majority in their state of residence if the age of majority is greater than 18) or older and who enter at winwithquest.com, which can be accessed through the weblink provided on Quest Diagnostics’ META®, X™, and Instagram® social media channels or scan the Quest Legacy Games QR Code on the Quest Diagnostics pennant giveaway that will be distributed at the New York Giants Legacy Games on October 22, 2023 and December 11, 2023 at MetLife Stadium. This Promotion is subject to all applicable federal, state and local laws and regulations. VOID OUTSIDE OF THE UNITED STATES AND WHERE PROHIBITED OR RESTRICTED BY LAW.

Employees, officers, representatives and their immediate family members and household members, whether or not related, of Quest Diagnostics Incorporated, New York Football Giants, Inc., Giants Stadium LLC, or New Meadowlands Stadium Company, LLC, and their respective parent companies, subsidiaries, affiliates, advertising or promotional agencies, fulfillment, marketing agencies and other third parties assisting or providing services in connection with this Promotion and the NFL Entities (as defined below) are not eligible to participate. For purposes of this Promotion, “immediate family members” means parents, spouses, children, and siblings, regardless of where they reside, and those living in their same households whether or not related.

The National Football League, its member professional football clubs, NFL Ventures, Inc., NFL Ventures, L.P., NFL Properties LLC, NFL Enterprises LLC and each of their respective subsidiaries, affiliates, shareholders, officers, directors, agents, representatives and employees (collectively, the “NFL Entities”) will have no liability or responsibility for any claim arising in connection with participation in this Promotion or any prize awarded. The NFL Entities have not offered or sponsored this Promotion in any way. THIS PROMOTION IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY ANY SOCIAL MEDIA SITE OF THE NFL ENTITIES.

No groups, clubs, or organizations may participate in this Promotion or reproduce or distribute any portion of these Official Rules or entry forms to their members. Winning the prize is contingent upon fulfilling all requirements set forth in these Official Rules.

3. HOW TO ENTER: There are two ways to enter the Promotion:

a. QR Code Entry: Scan the Quest Legacy Games QR Code located on the pennant giveaway, which will be distributed at the New York Giants Legacy Games presented by Quest Diagnostics on October 22, 2023 and December 11, 2023, and follow the instructions to enter your email address. You will be automatically entered into the Promotion when you click enter.

b. Website Link: Visit the website winwithquest.com, which can be accessed through the link provided on Quest Diagnostics’ META®, X™, or Instagram® social channels, and follow the instructions to enter your email address. You will be automatically entered into the Promotion when you click enter at winwithquest.com.

LIMIT ONE (1) ENTRY PER ENTRANT THROUGHOUT THE PROMOTION PERIOD REGARDLESS OF THE METHOD OF ENTRY.

Proof of submitting an entry does not constitute proof of receipt by Sponsor or eligibility. All entries become the property of Sponsor and will not be returned to the entrant or acknowledged. Entries submitted by script, macro or other automated or mechanical means, entries by any means which subvert the entry process, entries mechanically reproduced, and entries made in any fashion other than as specified herein are void and will be disqualified. Entry must be made by the entrant. One entry per entrant will be accepted. Each valid entry will have an equal chance of winning. Any attempt by entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, or any other methods, including, but not limited to, commercial contest/sweepstakes subscription notification and/or entering services, will void entrant’s entries and that entrant may be disqualified. Final eligibility for the award of a prize is subject to eligibility verification as set forth below. Sponsor shall determine eligibility of any entrant in its sole and absolute discretion. In addition, Sponsor may disqualify any entrant in its sole and absolute discretion.

In the event of a dispute, entries will be declared made by the authorized account holder of the email address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

4. PRIZE(S): Ten (10) signed New York Giants legacy jerseys (no authentication provided) of Sponsor’s choice, which have an approximate retail value of One-hundred U.S. dollars ($100.00) each.

All prize details are at Sponsor’s sole discretion. No more than the stated number of prizes will be awarded. Prize is awarded “AS IS” with no warranty or guarantee, either express or implied, by Sponsor. Prize is subject to the terms and conditions of the issuer, and Sponsor will not replace any lost or stolen prize. Except where prohibited by law, winner is solely responsible for all expenses not specifically included herein and all federal, state and/or local taxes, and fees in connection with a prize. Prize is non-transferable, and no substitution by winner or cash equivalent is allowed. Sponsor reserves the right, at its sole discretion, to substitute a prize (or portion thereof) with one of equal or greater value. Failure to comply with the Official Rules will result in forfeiture of a prize. If there is a monetary difference between the stated prize value and the actual prize value, the difference will not be awarded.

5. WINNER SELECTION: On or about December 13, 2023, ten (10) potential winners will be selected in a random drawing from among all eligible entries received during the Promotion Period. Odds of winning will depend on the total number of eligible entries received throughout the Promotion Period. All decisions of Sponsor regarding the Promotion are made in the Sponsor’s sole discretion and are final and binding in all respects. The potential winner is subject to verification by Sponsor.

6. WINNER NOTIFICATION: The potential winner will be notified by email at the email address provided during entry on or about December 19, 2023 (the “Notification”). The potential winner must follow the instructions provided in the Notification to claim his/her prize, which may include signing and returning an affidavit of eligibility and release of liability, and, except where prohibited by law, a publicity release (an “Affidavit”).

Sponsor is not responsible for any delay or failure to receive the Notification for any reason, including inactive email account(s), technical difficulties associated therewith, or winner’s failure to adequately monitor any email account. If a potential winner does not timely respond to the Notification, the Notification is returned as undeliverable within the Notification period, the potential winner does not properly execute an Affidavit, if required, the potential winner does not otherwise comply with these Official Rules, or the potential winner rejects or returns the prize, the potential winner may be disqualified and his/her prize may be forfeited, and Sponsor reserves the right, in its sole discretion, to select an alternate potential winner by random drawing from among all remaining eligible entries received. Potential prize winner must continue to comply with all terms and conditions of these Official Rules.

7. PRIVACY: You are providing your information to Sponsor and not to any social media site, and the information you provide will only be used in accordance with these Official Rules and Sponsor’s privacy policy. Entrant information received shall be treated by Sponsor in accordance with Sponsor’s privacy policy, which is located at: https://www.questdiagnostics.com/our-company/privacy/privacy-notice. Any questions regarding privacy matters pertaining to Quest Diagnostics should be directed to the following email address as set forth in the Sponsor’s privacy policy: Privacy@QuestDiagnostics.com.

8. GENERAL CONDITIONS: Participation in the Promotion constitutes entrant’s full and unconditional agreement to these Official Rules, and Sponsor’s decisions, which are made in Sponsor’s sole discretion and are final and binding in all matters related to the Promotion. Except where prohibited, participation in the Promotion constitutes entrant’s consent to Sponsor’s use of winner’s name, likeness, photograph, voice, opinion and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. Sponsor reserves the right to disqualify any entrant who is responsible for, tampers with, cheats, deceives, or otherwise engages in unfair practices concerning the administration, operation or security of the Promotion or intends to annoy, abuse, threaten or harass any other entrant or Sponsor. ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

9. LIMITATION OF LIABILITY: The Released Parties (as defined below) assume no responsibility or liability for (a) any late, lost, damaged, misdirected, incorrect or incomplete entries or any electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind or as a result of insufficient space in entrant’s email account; (b) any printing, typographical, human or other errors in the offer or administration of the Promotion, including, but not limited to, errors in any Promotion-related materials, including all advertising for the Promotion, these Official Rules and the distribution of the prize; (c) incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (d) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Promotion; (e) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers, software, communications devices, cables, phones, or providers utilized in any aspect of the operation or administration of the Promotion, the processing of any entries or communications, or the announcement of any prize or winner; (f) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (g) suspended or discontinued Internet, wireless or landline phone service; or (h) any injury or damage to participant’s or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Promotion or download of any materials in the Promotion. Sponsor reserves the right, in its sole discretion, to void any entries of entrants and disqualify entrants whom Sponsor believes have attempted to tamper with or impair the administration, security, fairness, or proper play of this Promotion and/or who are in violation of these Official Rules.

If the Promotion is not capable of running as planned for any reason, which may include, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, regularly scheduled maintenance, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, an act of God, supply shortages, natural disasters, epidemics, pandemics, or any other reason, the Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion in whole or in part. In such event, Sponsor shall immediately suspend the drawing and prize award, and Sponsor reserves the right to award the prize by random drawing using all known non-suspect, eligible entries received as of the date of termination in a manner deemed fair and equitable by Sponsor. Sponsor and Released Parties shall not have any further liability to any participant in connection with the Promotion.

10. RELEASE: Except where prohibited, by participating in the Promotion, entrants agree to release, indemnify, defend and hold harmless Sponsor, New York Football Giants, Inc., Giants Stadium LLC, New Meadowlands Stadium Company, LLC, and the NFL Entities and the respective officers, directors, owners, representatives, and employees of Sponsor, New York Football Giants, Inc., Giants Stadium LLC, New Meadowlands Stadium Company, LLC, and the NFL Entities and their respective parent companies, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies, fulfillment, marketing agencies and other third parties assisting or providing services in connection with this Promotion (“Released Parties”) from and against any claim, losses, liability, damages or cause of action arising out of participation in the Promotion or the receipt, acceptance, use or misuse of a prize, including, but not limited to: (a) unauthorized human intervention in the Promotion; (b) technical malfunctions related to computer hardware or software, servers, Internet connectivity, or telephone or network lines; (c) garbled, jumbled or faulty data transmissions; (d) typographical or printing errors in any Promotion-related materials; (e) errors in the administration of the Promotion or the processing of entries; (f) late, lost, delayed, intercepted or undeliverable mail or email; (g) unauthorized human or non-human intervention of the operation of the Promotion, including, without limitation, unauthorized tampering, hacking, theft, virus, bug, worm, or destruction of any aspect of the Promotion; or (h) injury, loss, accident or damage to persons or property and/or death, which may be caused, directly or indirectly, in whole or in part, from an entrant’s participation in the Promotion, an entrant’s breach of any agreement, warranty or representation associated with this Promotion, including these Official Rules, or receipt, use, or misuse of a prize. Each entrant further agrees that in any cause of action, the Sponsor and Released Parties’ liability will be limited to the cost of participating in the Promotion, and in no event shall the Sponsor or Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages (other than for actual out-of-pocket expenses) and any and all rights to have damages multiplied or otherwise increased.

11. GOVERNING LAW: The Promotion is governed by the laws of the State of New Jersey without regard to conflicts of law principles. Entrants consent to the jurisdiction and venue of the federal or state courts located in the State of New Jersey for the resolution of any disputes, claims and causes of action arising out of or relating to this Promotion or a prize (individually, “Claim”). All Claims shall be resolved individually, without resort to any form of class action. Any claims, judgments and/or awards shall be limited to actual out-of-pocket costs incurred, including without limitation costs incurred with entering this Promotion. Entrant hereby waives any rights or claims to attorney’s fees, indirect, special, punitive, incidental or consequential damages of entrant, identifiable persons, or third party participants, whether foreseeable or not and whether based on negligence or otherwise.

IF ANY SUCH PROVISION IS DETERMINED TO BE INVALID OR OTHERWISE UNENFORCEABLE, THESE OFFICIAL RULES SHALL BE CONSTRUED IN ACCORDANCE WITH THEIR TERMS AS IF THE INVALID OR UNENFORCEABLE PROVISION WAS NOT CONTAINED THEREIN.

BY ENTERING INTO THIS PROMOTION AND AGREEING TO THESE OFFICIAL RULES, YOU MAY BE GIVING UP IMPORTANT LEGAL RIGHTS – PLEASE READ ALL OF THESE OFFICIAL RULES CAREFULLY.

12. TRADEMARKS: Any mark appearing on the prize, as specified in section 4, is a registered trademark of New York Football Giants, Inc. and/or the National Football League. The Promotion is not sponsored, endorsed, administered by, or associated with the NFL Entities.

13. WINNER’S LIST: For the list of the winners, please mail a self-addressed stamped envelope to Quest Diagnostics Incorporated, 500 Plaza Dr. Secaucus, NJ 07094, ATTN: Marketing Department, after December 19, 2023. Requests must be received by Sponsor no later than December 31, 2023.
